With Weeto users can play music on events based on votes of people who are joined to those events. A user called "the host" creates an event and starts playing music from his/her device. The other users can join to that event by code shared by the host and vote for the songs which they want to be played next. The song with most points (called "weetos") will play next.
This App is being provided by its Publisher in an app store (“Platform”) of the individual operator (“Platform Operator”). Contractual partner of the User is the Publisher indicated therein, unless the provider information indicates a different provider, then that Provider (“Provider”) is beneficiary of this EULA, grants to the User respective rights to use the App and potentially provides support for the App.
The lawfully eligible User is granted the non-exclusive, non-sublicensable, nontransferable and revocable right to use the App free of charge in accordance with the EULA for private purposes only. The User is obliged and warrants to use the App only in a lawful manner and in accordance with this EULA and applicable laws.
The app is provided “as is”. In particular, no liability will be assumed for availability of the app and its content. Claims with regards to warranties for defects of the app are excluded. The same applies with regards to potential support.
To the fullest extent permitted by applicable law, in no event will the Publisher be liable to you on any legal theory for any incidental, direct, indirect, punitive, actual, consequential, special, exemplary, or other damages, including without limitation, loss of revenue or income, lost profits, pain and suffering, emotional distress, cost of substitute goods or services, or similar damages suffered or incurred by you or any third party that arise in connection with the services (or the termination thereof for any reason), even if the Publisher has been advised of the possibility of such damages.
To the fullest extent permitted by applicable law, the Publisher is not responsible or liable whatsoever in any manner for any content posted on or available through the services (including claims of infringement relating to that content), for your use of the services, or for the conduct of third parties on or through the services.
Certain jurisdictions do not permit the exclusion of certain warranties or limitation of liability for incidental or consequential damages, which means that some of the above limitations may not apply to you. In these jurisdictions, the foregoing exclusions and limitations will be enforced to the greatest extent permitted by applicable law.
The Publisher makes every effort to provide accurate and up to date information within the App. However, the publisher does not assume any responsibility regarding the completeness and accuracy of such information. The presentation of goods, services and prices is without any guarantee regarding its completeness and accuracy and does neither constitute a contractual offer nor a claim for conclusion of a contract.
Irrespective of a fault of the Publisher or the Provider, liability for fraudulent concealment of a defect, for acceptance of a guarantee or a procurement risk and after the Product Liability Act remains unaffected. Personal liability of legal representatives, vicarious agents and employees of the publisher and the provider for damages caused by ordinary negligence is hereby excluded.
In case a claim is being raised against the publisher or the provider of the App by the Publisher or the Provider of the App by a third party regarding a breach of the EULA by the User, the User indemnifies and holds harmless the Publisher and the Provider from any such claims and cost, that result directly or indirectly including reasonable cost for legal advice of and defense by an attorney. This does not apply as far as the user is not responsible for such a breach. The Publisher reserves the right to take over the defense against such claims.
Notwithstanding anything to the contrary in this section 3, nothing in this section 3 shall limit or exclude the liability of the publisher or of the provider to the extent that such limitation or exclusion is prohibited under applicable law.
The host of (and/or the responsible person for) the event playing music with Weeto should take care of all legal implications regarding performance rights organisations and collecting societies in given jurisdiction, including but not limited to paying all corresponding royalties and fees under applicable law, since Weeto acts solely as a music player and its services do NOT include any kind of licensing of music. For example, in Germany public events and/or locations playing music should pay corresponding fees and royalties to German collecting society and performance rights organisation called GEMA (in the USA - ASCAP, BMI, etc). The User must handle all such requirements under applicable law.
The Publisher reserves the right to change this EULA if he deems it necessary. If a User does not agree with a change, he has to uninstall the App and not use it any further. By further using the App the User agrees to the changed EULA.
We take privacy seriously at Weeto and this policy is designed to tell you what information we collect and how we use it. Please review this policy from time to time as we may make changes.
There are two types of data that websites and apps can collect about their users. The first one is called personal data. This is personally identifiable information that identifies a user as an individual.
Weeto is currently used without registering an account. Weeto stores the events that you have joined, although not the actual location information of the user, since the event can be joined from any place. This information is also not shared with any third parties. All the information can be deleted if desired.
The second type is non personal data which doesn't directly identify an individual. Weeto may collect non personal information about the use of the app to help us improve our services, if the User has consented to it. Weeto also uses Google Analytics for these purposes, its Terms of Service can be found here: English | German.
